BEAUMONT, Texas - A Texas appellate court on Oct. 21 vacated certification for a potential class of 400,000 homeowners who want the court to force insurers to offer renewals of pre-2002 insurance policies that don't exclude mold. Farmers Group Inc., et al. v. Geter, Nos. 09-03-404 and 09-03-396 (Texas App., 9th Dist. Ct.).
The Ninth District Court of Appeals majority didn't rule on the merits of the case, but said the trial court failed to address all necessary certification issues.
