PORTLAND, Ore. - A federal court has denied property owners' request for an injunction to force a home insurer to continue coverage of a mold-contaminated house. Heer v. State Farm Fire and Casualty Co., No. 04-6211-HO (D. Ore.).
Larry Heer and Alfred Holman sued State Farm Fire and Casualty Co. after State Farm declined to pay for additional repairs to a rental property in Albany, Ore., owned by plaintiffs. Heer and Holman contend that a failed pipe beneath the house led to extensive mold contamination throughout the house, which has left the house uninhabitable.
