MINEOLA, N.Y. - A couple who proved to a court's satisfaction they didn't own their house during the offending time period were granted summary judgment on claims they intentionally directed mold spores from an attic fan to a neighboring home. Bowes v. Healy, No. 009944/2003 (N.Y. Supr., Nassau Cty.).
New York Supreme Court Justice F. Dana Winslow ruled on Aug. 6 that Michael and Debra Healy proved to the court's satisfaction they didn't own the home during the period in which neighbors Craig Bowes and Elizabeth Feudale complained of mold contamination.
