Court Asks for Expert Testimony on Standard of Care for Landlord, HVAC Vendor

GEORGETOWN, Del. -- A Delaware Superior Court has ordered an office to provide expert testimony on the standard of care owed by the landlord and HVAC or risk summary judgment. Brandt v. Rokeby Realty Co., et al., No. 97C-10-132-RFS (Del. Super. Ct.).

In a Sept. 8 letter opinion, Delaware Superior Court Judge Richard F. Stokes said the standard of care issues were not beyond the common knowledge of jurors and he gave plaintiff Charles Brandt 90 days to provide expert testimony.
