N.Y. Court Denies Demand That Landlord Pay for Mold Removal Specialist

NEW YORK - A New York court has refused a petitioner's request that her landlord hire a licensed mold removal professional, stating that the court will avoid granting injunctive relief where monetary damages are adequate. Firtell, et al. v. Bristol Management Company, et al., No. 108357/04 (N.Y. Sup. Ct., N.Y. Cty.).

In an Aug. 2 opinion, the New York Supreme Court for New York County opined that since the petitioner already expressed dissatisfaction with a prior mold relief effort, there would be no guarantee that injunctive relief would end the damage the petitioner alleges.
