NEW YORK - A New York trial court has denied a family's request for an injunction against their condominium association, saying the relief sought is either premature or compensable by money damages. Zalabak v. Village Point Condominium, No. 106165/2004 (N.Y. Sup., N.Y. Cty.).

Marisa Zalabak and her daughter, Thea, are living in rented housing paid for by the Village Point Condominium Board of managers while mold is being removed from their condominium unit. Village Point has agreed to pay for eight months of rental payments, but Zalabak asked the New York County Supreme Court to order an additional four months …
