DALLAS - A federal court ordered a homeowner's suit for mold coverage remanded to state court on April 25, after finding that a defendant insurance adjuster could be liable for recommendations made outside the scope of his employment by the insurance company. Pollman v. American Safety Indemnity Co., No. 3:03-CV-2883-K. (N.D. Texas).
Harold A. and Leah Pollman sued American Safety Indemnity Co. for breach of contract and alleged violations of the state insurance code and Deceptive Trade Practices Act over coverage for mold and water damage arising from a fire at an apartment complex they owned in 2001.
