ELGIN, Ill. - The economic loss rule bars developers seeking contribution for their settlement with homebuyers complaining of mold intrusion, an Illinois court affirmed May 13. Muirfield Village-Vernon Hills LLC v. K. Reinke Jr. and Co., et al., No. 02-03-0116 (Ill. App., 2nd Dist.).
But the Illinois Court of Appeals, 2nd District, said the developer could file a fourth amended complaint to seek contribution from subcontractors for damage to the homebuyers' personal property.
