KANSAS CITY, Mo. -- A Missouri appellate court on April 6 affirmed a judgment awarding homeowners damages for repairs and diminution of value because of mold, but conditioned the ruling on the homeowners accepting less than half of the jury verdict. Ince v. Money's Building & Development, No. ED82899 (Mo. App., Eastern Dist.).

Charles Ince and other family members have asked the Court of Appeals, Eastern District, for a rehearing. The Inces were given 15 days after filing of the court's mandate to decide whether to accept a remittitur from the $420,000 awarded by a Jefferson County jury to $183,380.07.
