ST. PAUL, Minn. - Homeowners who were warned of a damp basement and stucco discoloration prior to purchase were on notice of potential problems and can't sue the home sellers or builders more than two years after the sale, Minnesota's Court of Appeals affirmed April 6. Oie v. Kroiss Construction. No. A03-1135 (Minn. App.).
Casey and Molly Oie sued Kroiss Construction, the builder of their home, and Paul and Judith Kelly, the previous owners, after experiencing water damage and mold in their home in the summer or fall of 2000.
