MILWAUKEE - Wisconsin's Court of Appeals has dismissed a couple's appeal of summary judgment granted to their home insurer, finding the appeal untimely. Contardi v. American Family Mutual Insurance Co., No. 03-2284 (Wis. App. Ct.).
The Court of Appeals, Division One, found in an April 20 per curiam opinion that the summary judgment order issued in favor of American Family Mutual Insurance Co. was meant to be a final, appealable order, and that Daniel and Christine Contardi, failed to file their appeal within the allowed time.
