Mold and Water Damage During Remodeling Results In $1,000 Verdict

AUSTIN, Texas - An Austin couple who complained that their insurer underpaid their claim for mold and water damage were awarded another $1,000 recently by a jury in Travis County, Texas. McMillin v. State Farm Lloyds, No. GN200297 (Texas 345th Dist. Ct., Travis Cty.).
William McMillin and his wife, Mary Furse, sued State Farm Lloyds for breach of the duty of good faith and fair dealing, violations of the Texas Insurance Code and the Texas Deceptive Trade Practices Act and breach of contract.
McMillin and Furse complained that State Farm conducted a late and insufficient investigation of their claim. …
