RALEIGH, N.C. - A North Carolina appellate court on March 16 reinstated a worker's claims against a building manager and owner, concluding they fit within exceptions to the exclusivity provisions of the state's workers' compensation act. Cameron v. Merisel Inc., et al., No. COA2-1330 (N.C. App. Ct.).
The Court of Appeals did affirm dismissal of claims against Tommy D.N. Cameron's employer, finding they did not fall within the exception because the allegations of 'serious illnesses' suffered by co-workers were unsubstantiated.
Cameron was employed by Merisel Americas at a remote customer call center from December 1998 through April 2000. The …
