Court Refuses to Order FEMA Employees to Testify in Flood Insurance Case

WASHINGTON, D.C. - A plaintiff seeking review of the Federal Emergency Management Agency's refusal to allow its employees to testify in a private breach-of-contract action over flood insurance is limited to avenues available under the Administrative Procedures Act, a federal magistrate judge said Jan. 10 in dismissing a motion to compel. Truex v. Allstate Insurance Co., No. 05-00439 (D.D. C.).

Judge Ellen S. Huvelle of the U.S. District Court for the District of Columbia adopted the report and recommendations by Magistrate Judge John M. Facciola on Jan. 26.
