SACRAMENTO, Calif. - A California appellate court on Jan. 31 affirmed summary judgment for defendants in a construction defect case for plaintiffs' failure to bring the case to trial within five years of filing. Triche v. Taylor, No. C046145 (Calif. Ct. App., 3rd Dist.).

California's 3rd Appellate District affirmed the decision by the Sacramento County Superior Court in an unpublished opinion, concluding that Alma M. Triche failed to show that the trial court abused its discretion in rejecting her bid for an exception to a statutory requirement that cases be tried within five years of commencement.
