Mich. Homebuyers Signed Release And Can't Sue Real Estate Agents

LANSING, Mich. - Language in a standard purchase contract stipulating that real estate agents made no representation as to the condition of the property precludes buyers from suing when they later discover mold, a Michigan appellate court affirmed Feb. 19. David C. Sharpe, et ux. v. Frances Elizabeth Taber, et al., No. 244040 (Mich. App.).
Michigan's Court of Appeals rejected the assertion by plaintiffs David C. and Donna L. Sharpe that the release they signed at closing was invalid because the agents misrepresented the condition of a house they were shown in October 1999 and purchased shortly thereafter.
