Court Denies N.Y. City Residents Access To Environmental Report




NEW YORK - Residents of a cooperative apartment complex who requested an inspection of leaks and peeling paint are not entitled to pre-litigation access to the resulting environmental report, a New York Supreme Court ruled recently. Carmen Baez v. 299 Pearl Street, No. 117367/2003 (N.Y. Sup., N.Y. Cty.).

Carmen and Christopher Baez petitioned the New York County Supreme Court to order Southbridge Towers Inc. to provide copies of reports of an inspection undertaken on Aug. 19 and 20 by Airtek Environmental Corp. The Baezes said the inspection was in response to their complaints to the co-op board and managing agent.
