Appeals Court Upholds $55,000 Jury Verdict in EIFS Case

RALEIGH, N.C. - An appeals court recently affirmed a jury verdict of $55,000 against a development company for structural damages to a North Carolina home clad in Exterior Insulation Finish Systems (EIFS). Ben and Yvette Coates v. Niblock Development, Corp., No. COA03-479 (N.C. App. Ct.).

According to the Dec. 2, 2003, opinion, the North Carolina Court of Appeals affirmed the judgment entered Oct. 22, 2002, in Cabarrus County Superior Court finding that the homeowners successfully presented evidence showing damage to the load bearing elements of the house that caused it to be unsafe or unlivable.
