PHOENIX, Ariz. - Two medical experts scheduled to testify on neurological and immunological abnormalities allegedly caused by exposure to toxigenic mold and associated mycotoxins in an apartment complex have survived a Frye challenge. Kari Kilian, et al., v. JWE Management Co., et al., No. CV2000-014108 (Ariz. Super. Ct., Maricopa Cty.).
According to a Sept. 19 ruling by the Arizona Superior Court of Maricopa County, Frye does not apply in this case because the experts' testimony does not rely on new scientific tests or techniques, and the two medical doctors appear to be qualified in the areas in which they are …
