Court Sustains Builder's Motion for Directed Verdict in Mold Case

HAMILTON, Ohio - At the conclusion of the plaintiff's arguments in a mold-related defects, fraud and personal injury case against a home builder, the court sustained the defendant's motion for directed verdict, dismissing the case with prejudice. Sheila A. Marshall, et al. v. Henry Fischer Builder, Inc., No. CV-01-12-2851 (Ohio Comm. Pls., Butler Cty.).

According to the Aug. 8 final judgment, the Butler County Court of Common Pleas found that the only reasonable conclusion to the evidence presented by the plaintiff is "adverse" to her case and, therefore, directed a verdict in favor of the home builder on all claims.
