WASHINGTON - A U.S. District Court has dismissed without prejudice an insurance company's declaratory judgment action regarding its obligation to indemnify the developers and contractors of a luxury condominium building for claims filed against the insured for water damage, mold damage and construction defects. TIG Insurance Company v. 2200 M Street, L.L.C., et al., No. 02-2405 (RMU) (D. D.C.).

According to the June 9 memorandum opinion dismissing the case, insurer TIG Insurance Company failed to serve the complaint within the timeframe allowed by law.
