RIVERHEAD, N.Y. - A school district's motion to dismiss a contract dispute with a company it hired to perform asbestos and mold remediation work at an area school has been dismissed, allowing the case to proceed through discovery. Benito San Pedro Associates, Inc., d/b/a Brad Associates v. Amityville Union Free School District, No. 02-21130 (N.Y. Sup. Ct., Suffolk Cty.).
The order denying the motion was filed Feb. 25 and indicated that the school district's arguments that the case was time-barred were unsuccessful.
