SAN DIEGO - A California appeals court has affirmed summary adjudication, nonsuit and an award of directed verdict on behalf of Western Mutual Insurance Company after finding that the insured homeowner failed to provide an adequate appellate record. Joy Craft v. Western Mutual Insurance Company, No. E030318 (Calif. Ct. App., 4th Dist, Div. 2).
According to a Feb. 14 opinion regarding this appeal of a breach of contract and bad faith case for a rain-damaged, mold-infested house, Joy Craft failed to meet her burden of demonstrating reversible error by the Orange County trial court.
