Mold Is Excluded as a Covered Loss in Homeowners Policy, District Court Says

PHOENIX - An Arizona district court on Jan. 21 granted an insurer's motion for summary judgment, upholding the exclusion of mold as a covered loss in the insured's homeowners policy. Shirley Cooper vs. American Family Mutual Insurance Company, et al., No. CV 00-1097 PHX-JAT (D. Ariz.).
The court granted the defendant's motion for summary judgment because, according to the U.S. District Court's decision, "it is clear -- and should be to a layman -- that loss caused by mold is excluded" under the policy.
