Appeals Court: Substantial Property Damage Caused by Defective Pipe, Case Remanded For Reconsideration of Credits

SAN FRANCISCO - A California appeals court has found that the owners of an apartment complex proved their claims of substantial damage caused by defective above-slab pipe that caused sewage leaks, mold and structural rotting. Vacaville Quail Run v. Gable Plastics, Inc., No. A092651 (Calif. Ct. App., 1st App. Dist., Div. 1).
The First District California Court of Appeal's Jan. 30 decision substantially favors the plaintiff, but because the defendants were not all jointly and severally liable for the same tort the appeals court was remanded for reconsideration of credit allocations from prior settlements.
