Appellate Panel Says Texas Trial Court Lacked Jurisdiction to Award Costs

HOUSTON - A trial court that awarded costs to a settling plaintiff months after dismissing the case lacked jurisdiction to do so, a Texas appellate court held May 19. Germania Farm Mutual Insurance Association v. Schild, No. 14-04-00527-CV (Texas 14th Ct. App.).

The Texas Fourteenth Court of Appeals said the Texas Rules of Civil Procedure provide that a trial court's plenary jurisdiction expires 30 days after a signed order of dismissal.
