Public School Teachers Attempt to 'Pierce the Cloak of Immunity' in Refiled Mold Complaint

DAYTON, Ohio - By refiling a case against the West Carrollton school board and superintendent alleging concealment of dangerous mold, a group of public school teachers and students says it hopes to simultaneously combat Ohio's restrictive sovereign immunity statute. The Jan. 23 complaint is a refiling of a suit originally filed Aug. 27, 2001, in Montgomery County Court of Common Pleas by three teachers. The new complaint adds several students as plaintiffs. It also adds the claim that the …
