DAYTON, Ohio - By refiling a case against the West Carrollton school board and superintendent alleging concealment of dangerous mold, a group of public school teachers and students says it hopes to simultaneously combat Ohio's restrictive sovereign immunity statute. Susan Googash, et al. v. West Carrollton Board of Education and Dr. Rusty Clifford, No. 02-485 (Ohio Comm. Pls., Montgomery Cty.).

The Jan. 23 complaint is a refiling of a suit originally filed Aug. 27, 2001, in Montgomery County Court of Common Pleas by three teachers. The new complaint adds several students as plaintiffs. It also adds the claim that the …
