MIAMI - On Jan. 6, the Circuit Court of the 11th Judicial Circuit for Miami-Dade County, Fla., granted class certification for the residents and former residents of a 452-unit apartment building that is extensively contaminated with mold. Rachel J. Henriques, et al. v. Archstone-Smith Operating Trust, et al., No. 02-21697 CA 02 (Fla. Cir. Ct., 11th Jud. Cir., Miami-Dade Cty.).
According to the order, the plaintiffs' motion to certify their breach of warranty/negligence complaint as a class action has been granted on all counts except fraud.
