AUSTIN, Texas - According to a Nov. 1 verdict, a Texas jury found in favor of the defendant in a case in which a homeowner sued a water extraction contractor, alleging that it negligently caused the conditions that fostered mold growth and, secondarily, mold-related personal injuries. James Long v. Austin Hi-Tech Restoration, et al., No. GN000463 (Texas. Dist. Ct., 261st Jud. Dist., Travis Cty.).
The jury found that negligence on the part of the homeowner proximately caused the damages to his house and contents, and awarded counter-claim damages to the contractor, Austin Hi-Tech Restoration, in the amount of $5,559, plus …
