WILMINGTON, Del. - The former owners of a 39-building apartment complex are suing local officials for condemning the buildings in 2002 for mold contamination without holding a hearing or allowing remedial work. Elsmere Park Club v. Town of Elsmere, No. 04-1321 (D. Del.).
Elsmere Park Club is defending a separate action by tenants, who were recently denied class certification on landlord-tenant claims (Manuel v. Elsmere Park Club, et al., No. 02C-10-212, Del. Super.; See HarrisMartin Columns: Mold, June 2004, p.16).
