ST. PAUL, Minn. - A Minnesota couple was unsuccessful in their appeal of a lower court's granting of summary judgment on behalf of their insurance company in a case concerning mold growth due to continuous or repeated plumbing leaks. Kenneth Myers, et al. v. State Farm Fire and Casualty Company, No. C8-02-62 (Minn. App.).
In the July 16 decision, the appeals court affirmed the lower court's finding that because the plaintiffs' homeowners' policy expressly excludes coverage for damages cause by chronic leaks, the damage to the home in this case was not covered in spite of the plaintiffs' argument that …
