PHOENIX, Ariz. - Shortly after a state court ruled that two medical experts, who were scheduled to testify on neurological and immunological abnormalities allegedly caused by mold exposure an apartment complex, survived a Frye challenge, the court granted the defendant's Motion to Stay pending an interlocutory appeal on the matter. Kari Kilian, et al., v. JWE Management Co., et al., No. CV2000-014108 (Ariz. Super. Ct., Maricopa Cty.).
The formal ruling was filed Oct. 8 by the Arizona Superior Court of Maricopa County, staying the action pending the landlord defendant's interlocutory appeal of the pro-plaintiff Frye ruling.
