Ohio Tenant-Purchaser Fails to Persuade Court to Overturn Damages Award

COLUMBUS, Ohio - An Ohio appeals court that ordered a new trial on damages two years after a jury found for a tenant-purchaser but awarded no damages for a mold claim has substantially affirmed the trial court's subsequent judgment awarding the landlord-seller most of an escrow fund on his breach-of-contract counterclaim. Meyer v. Chieffo, No. 10AP-683 (Ohio Ct. App., 10th Dist.).

The 10th District Court of Appeals did allow Dominic Chieffo's $4,071.60 award for mold, but awarded the remainder of a $42,425 escrow account to the landlord-property owner, subject to reconsideration of about $6,000 in utility expenses.
