Court Rejects Mold Evidence as Support for Homeowners' Water Damage Claim

LOS ANGELES - Homeowners who did not sue for mold damages cannot cite mold contamination and related inspection costs to counter their neighborhood association's motion for summary judgment on other specified damage claims, a California appellate court has affirmed. Peterson v. Bridgeport Community Association Inc., No. B217194 (Calif. Ct. App., 2nd Dist.).
The California Court of Appeal, Second District, said April 13 in an unpublished opinion that while evidence offered in opposition to such motions should be liberally construed, the mold damage cited did not fit within the very specific damage claims made by plaintiffs.
