Wis. Condo Developers Lose Bid to File Cross-Claims Against Co-Defendants

MADISON, Wis. - A Wisconsin appellate court has affirmed an order preventing the defendant developers of an allegedly leaky condominium building from filing cross-claims against the development's architects, construction manager and structural engineers. Commerce Bluff One Condominium Association Inc., et al. v. Dixon, et al., No. 2009AP1953 (Wis. Ct. App., Dist. 1).
Wisconsin's Court of Appeals, District 1, said March 1 that it found no abuse of discretion in the trial court's denial of the developers' motion to file negligence and indemnity cross-claims against co-defendants and declined to address other non-final orders involving other parties.
