NEW YORK - A New York judge has ordered the parents of a minor plaintiff to schedule a medical examination for the child within 30 days or face dismissal for failure to prosecute the family's mold injury lawsuit. Craddock v. City of New York, No. 19948/2004 (N.Y. Sup. Ct., N.Y. Cty.).

Queens County Supreme Court Justice David Elliot signed the order on March 3 while at the same time denying a cross motion by the defendant New York City Housing Authority to dismiss for failure to prosecute the 7-year-old lawsuit.
