Failure to Seek Medical Help Doesn't Save Untimely Michigan Claim

TROY, Mich. - The statute of limitations on a negligence claim for mold damage began to run when the tenant noticed leaks and experienced respiratory symptoms, not when she sought medical treatment that linked her condition to possible mold exposure, a Michigan appellate court has ruled. Brooks v. Willow Tree Village, et al., No. 29544 (Mich. Ct. App.).
The Michigan Court of Appeals said in an unpublished opinion on March 1 in affirming summary judgment for a mobile home park's management company that Michigan has not adopted a broad discovery rule that would toll the negligence claim in this case.
