N.Y. Court Allows Insurer to Renew Motion to Dismiss Subcontractor's Coverage Suit

MINEOLA, N.Y. - A New York trial court has allowed an insurer to renew its motion to dismiss a coverage action filed by an engineering consulting firm defending against mold claims after the carrier asserted that technical failings in the original motion have been addressed. M.G. Consulting Services Inc. v. Utica Mutual Insurance Co., et al., No. 10690/2009 (N.Y. Sup., Nassau Cty.).
Nassau County Supreme Court Justice Ira B. Warshawsky said in a Jan. 28 order that reargument was appropriate under the circumstances and he scheduled a Feb. 28 hearing on the merits of the motion.
