DENVER - The 10th Circuit Court of Appeals has affirmed judgment for a home insurer in a duty to defend case, agreeing that the policy did not cover property damage claims brought by homebuyers against the insured sellers. Panico, et ux. v. State Farm Fire and Casualty Co., No. 10-1219 (10th Cir.).
The order affirming the ruling for State Farm Fire and Casualty Co. was released on Feb. 3.
David K. and Janice L. Panico owned a house in Aspen, Colo., that was primarily constructed by David Panico. It was insured through State Farm.
