Sand Bags Should Have Alerted Homebuyer to Flooding, Court Says

BOWLING GREEN, Ohio - Sand bags near the house and evidence of water damage in a finished basement should have alerted a homebuyer to possible flooding, an Ohio appellate court said in affirming a ruling for real estate broker. Fleck, et al. v. Loss Realty Group, et al., No. WD-10-011 (Ohio Ct. App., 6th Dist.).
Ohio's Sixth Appellate District on Jan. 14 affirmed a trial court order dismissing a couple's misrepresentation claims against a real estate firm that showed them a foreclosed property they eventually bought.
