PHILADELPHIA -- Water damage to an insured New Jersey contractor's own work is not covered by a commercial general liability policy, the 3rd Circuit Court of Appeals has affirmed. Pennsylvania National Mutual Casualty Insurance Co. v. Parkshore Development Corp., et al., No. 09-3821 (3rd Cir.).
The Circuit Court found for Pennsylvania National Mutual Casualty Insurance Co. on Dec. 10, ruling in an unpublished opinion that New Jersey courts have not expanded their definition of an "occurrence" to include an insured's own work product.
