TOLEDO, Ohio - An appellate court has affirmed the judgment for a contractor blamed by homeowners for roof leaks and mold problems, rejecting the homeowners' argument that the trial court erred in allowing jurors to hear evidence of insurance coverage and payments. Newmyer, et al. v. Seitz Design & Construction Inc., et al., No. E-09-045 (Ohio Ct. App., 6th Dist.).
The three judge panel were unanimous in affirming the judgment for Seitz Design & Construction Inc. and its principals on Dec. 17, but one justice wrote a separate concurring opinion to express his opinion on the admission of insurance coverage …
