N.Y. Trial Judge Finds for Homeowners on Bad Faith Claim Against Insurer

WESTCHESTER, N.Y. - A New York trial court has awarded summary judgment as to liability on two bad faith counts brought against Allstate Insurance Co. by homeowners who alleged delay in settling what began as a fire damage claim. Carden, et ux. v. Allstate Insurance Co., No. 1807/2009 (N.Y. Sup. Ct., Westchester Cty.).

Westchester County (N.Y.) Supreme Court Acting Justice Gerald E. Loehr found for Donald and Barbara Carden on their bad faith counts on Dec. 10, and also awarded compensatory damages for damage to the driveway that occurred during reconstruction of their house.
