CANTON, Ohio - An Ohio appellate court rejected statute-of-limitations and other challenges to a judgment for breach of warranty but ruled that the trial court applied the wrong measure of damages and remanded the case for reconsideration on that basis. Huff v. All American Basement Waterproofing and Home Services Inc., No. 10 COA 008 (Ohio Ct. App., Ashland Cty., 5th Dist.).
The Fifth Appellate District in Ashland County (Ohio) on Dec. 7 rejected other assignments of error raised by All American Basement Waterproofing and Home Services Inc., including statute of limitations and burden of proof.
