Colo. Court Says Insurer Had No Duty to Supervise Contractor

DENVER - Colorado's Court of Appeals has reversed summary judgment awarded to an insurer as premature, although it affirmed the lower court's finding that homeowners could not assert bad faith claims based on the carrier's alleged failure to supervise remediation contractors. Dunn, et al. v. American Family Insurance, No. 09CA2173 (Colo. Ct. App.).
The court concluded in its Nov. 24 opinion that summary judgment was inappropriate given the dispute over whether the carrier responded promptly to its insureds' claim, and remanded to the Arapahoe County (Colo.) District Court for reconsideration on that issue.
