CLEVELAND - Whirlpool Corp. is appealing a July 12 order certifying a class of Ohio owners who can sue the manufacturer over mold and other problems allegedly arising from poorly draining washing machines. In re: Whirlpool Corp., No. 10-0312 (6th Cir.).
The 6th Circuit Court of Appeals granted Whirlpool's motion on Sept. 28, saying the question of whether the trial court must resolve disputed issues of fact under Rule 23 before certifying a class is an unsettled one in the circuit.
The court has not issued a briefing schedule in this appeal.
