Court Refuses to Reopen Discovery so Plaintiffs Can Pursue Mold-ADHD Link

GEORGETOWN, Del. - A Delaware trial court has denied a motion to postpone a scheduled January trial while plaintiffs investigate a link between mold and their child's newly diagnosed Attention Deficit Hyperactivity Disorder, saying the internet "evidence" offered is insufficient to support the motion. Murphy, et al. v. Delmarva Homes Inc., No. 07C-12-028 RFS (Del. Super. Ct., Sussex Cty.).

Superior Court Judge Richard F. Stokes also said in his Oct. 5 order that the materials cited by plaintiff Jennifer Murphy are unscientific and would not be admissible even if the court were to reopen discovery.
