RIVERHEAD, N.Y. - The second of two insurers for a contractor-defendant in a construction defect case has been dismissed from a declaratory judgment action brought by plaintiffs in the underlying lawsuit. LaCava v. Nova Casualty Co., et al., No. 21934/2009 (N.Y. Sup. Ct., Suffolk Cty.).

The Sept. 7 order granting summary judgment to Nova Casualty Co. on subrogation claims was unopposed by plaintiffs James and Christine LaCava, and follows the April 20 dismissal of the only other defendant, Colony Insurance Co.
