NEW YORK - A New York court has dismissed condominium owners' claims against their building manager but ruled that they can still pursue negligence claims against the condominium board arising from a water leak and resulting mold damage. Columbia Condominium v. Alevy, No. 105846/2009 (N.Y. Sup. Ct., N.Y. Cty.).
New York County Supreme Court Justice Doris Ling-Cohan ruled on Aug. 25 that negligence and other claims by Steven M. Alevy and his family against the Residential Board of Managers of the Columbia Condominium were deficient as a matter of law.
