PHILADELPHIA - The 3rd Circuit has rejected allegations by an African-American family that a mortgage lender's requirement that mold and water damage be repaired before the loan process could be completed was discriminatory. Anderson, et al. v. Wachovia Mortgage Corp., et al., Nos. 09-2275 and 09-2336 (3rd Cir.).
The Circuit Court panel on Sept. 13 affirmed judgment for Wachovia Mortgage Corp. on the discrimination claim, but also affirmed the decision by the U.S. District Court for the District of Delaware to deny summary judgment on a bad faith claim based on the same facts and remand the case to state …
